1. The operator’s identity and contact information
The owner of www.theestate.ro website (the "Site") is Quality Home Consulting S.R.L., a limited liability company with registered office at 42 Gladitei Street, tower T5, 14th floor, ap. 1405, sector 4, Bucharest, registered with the Bucharest Trade Register Office under no. J40 / 6843/2012, Unique Registration Code 30316693, as operator, ("the Operator").
The site is accessible for: (i) the wide public („Users”) for information regarding the products of the company; and (ii) the company’s customers („Customers”) for displaying certain information regarding the properties administered by the Operator.

2. Services

All services presented on the Operator's site are displayed in an informative manner - the details of the services provided will be established by contract with the customers - some services thus negotiated may have significantly different characteristics. The pictures are purely decorative.
Some services may not be available on a case-by-case basis. The operator will confirm the availability of services at the time of processing a User's request.

3. Additional information

The Operator will endeavour to provide additional information to Users regarding the services displayed on the Site but is not required to respond to all requests.

4. Intellectual property

The content of the Site, including but not limited to logos, stylised representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, represents the exclusive property of the Operator if it does not belong to other manufacturers or distributors, as they benefit from all their rights directly or indirectly obtained (by means of use and/or publication licenses) („Intellectual Property”).
The Operator reserves all intellectual property rights and the Site's visitors are not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any element of the Intellectual Property.

5. Customer Information

The Operator will provide Customers through the "Customer Login" section certain data on the properties of each Customer which are under the management of Quality Home Consulting Ltd. The data will be displayed in a secured area accessible only by a unique combination of user name and password.
The nature and categories of data displayed will be determined by the Operator. Content may vary at the Operator's own choice.
The operator does not guarantee the accuracy and actuality of the data displayed in the "Customer login" section - for updated information, Customers must contact the Direct Operator.

6. Contact

The Customer agrees that the Operator may contact it, by any means available/agreed by the Operator, in any situation where the Customer is required to be contacted.

7. Document changes

These General Conditions are periodically updated; whenever the Operator makes a change, it will display it on the Site.

The site is accessible for: (i) the wide public („Users”) for information regarding the products of the company; and (ii) the company’s customers („Customers”) for displaying certain information regarding the properties administered by the Operator.

Any request regarding personal data may be sent to the email address office@theestate.ro or by mail at 42 Gladitei Street, tower T5, 14th floor, apartment 1405, sector 4, Bucharest, for the attention of the data protection appointed person.

3. Collected information

The information that the Operator collects regarding the Site's Users consists, in principle, of:
a) The electronic identification data of the Site's visitors along with any information provided by cookies and web signs (IP address, browser type, pages that users browsed, etc.);
b) Customer identification and contact details (name, surname, address, e-mail, telephone, username, password etc.);
c) Information on the use of the Site or how to navigate the Site;
d) Information about subscribing to the newsletter (e-mail).

4. The purpose of the processing

The purposes for which personal data is collected include:
(i) The provision of the Customer’s information service - letters a), b) and c);
(ii) Direct marketing – letter d);
(iii) Statistics regarding the Site traffic and User activity - letter a) and c).

5. Legal grounds

The operator processes personal data on the basis of the following legal grounds:
(i) the execution or conclusion of the Customer Agreement and the provision of Services - paragraph (i) above;
(ii) the legitimate commercial interests of the Operator, for example, the prevention of fraud and the improvement of services and products; The Operator will assess its commercial interests on a case-by-case basis to ensure that they do not override the rights of the person concerned - letter (iii) above;
(iii) the consent given by the persons concerned when the Operator does not rely on any other legal ground; consent may be withdrawn at any time - letter (ii) above and any other applicable case;

6. Recipients or categories of recipients of personal data

The operator may transfer the personal data of the persons concerned to partners and collaborators strictly for the purposes of carrying out its commercial activity. Third parties to whom personal data may be transferred include:
(i) Site and Customer Information Platform developers;
(ii) Web traffic data analysis companies (e.g. Google Inc.);
(iii) E-mail marketing agents (e.g. MailChimp);
(iv) Other subcontractors.
The Operator shall ensure that it concludes contracts with third parties in order to ensure an adequate level of protection of personal data and that any processing will take place in accordance with the applicable legislation in the field.
The Operator will not transfer personal data to a third country. As an exception, it is possible that some data regarding direct marketing campaigns to be transfered to empowered persons in third party countries, countries which offer a similar protection level or to the US (only companies subscribed in EU-US Privacy Shield). Such transfers will be done based on given agreement according to the Privacy, marketing and commercial communications policy.
If the Operator undergoes a reorganization or sales procedure to another organization, it will communicate the concerned person's information to the respective organization.

7. Storage period

The operator will store the information of the concerned persons as long as it is required by applicable law. If there is no legal requirement or if the legally binding term has ceased, the Operator will only store the data for as long as it is necessary depending on the purposes for which it was collected.
Unless the law otherwise provides, as a rule, the data will be processed for the period until the termination of the service contract plus the required period until the prescription of any contractual obligations. Data collected for direct marketing will be processed until the right to unsubscribe is exercised.

8. Rights of the concerned person

Regarding the personal data of the concerned persons, the concerned persons will have the right to request the Operator, the access, rectification or deletion of personal data, or the restriction to process or the right to oppose the processing, in compliance with the applicable legislation in the field. The Operator will also ensure the right to data portability.
When processing is based on the consent of the concerned person, the concerned person will have the right to withdraw its consent at any time without affecting the lawfulness of the processing made based on the consent prior to its withdrawal.
The person concerned has the right to file a complaint with the National Supervisory Authority for Personal Data Processing or with any competent authority if the person concerned considers that its personal data rights have been violated.

9. The compulsoriness of providing personal data

The provision of personal identification data, e-mail address, username and password is essential for providing the service corresponding to the Customer Information Platform.

Privacy, marketing and commercial communications policy

All electronic communications to e-mail addresses collected through the www.theestate.ro site (the "Site") or by another method are made by Quality Home Consulting SRL, a limited liability company having its registered office at 42 Gladi?ei Street, tower T5, 14th floor, ap. 1405, sector 4, Bucharest, registered with the Bucharest Trade Register Office under no. The site is accessible for: (i) the wide public („Users”) for information regarding the products of the company; and (ii) the company’s customers („Customers”) for displaying certain information regarding the properties administered by the Operator.

1. Privacy
Apart from the Personal Data Processing Policy, The Operator undertakes to keep confidential any information about Users or Customers.
The Operator may disclose such information to affiliated companies, subcontractors and partners with whom it collaborates in order to carry out business or marketing activities within the limits of the applicable law.

2. Commercial communications
By ticking the box "I agree to be contacted regarding various offers or updates from theestate.ro" or any similar description, or by entering the e-mail address in the "Newsletter subscription" field, the User or the Customer expressly accepts the possibility to receive by e-mail or by any other means of communication similar offers, newsletters and other commercial communications.
The User or the Customer may at any time change the option regarding the agreement given to the Operator for commercial communications containing general and thematic information including information on offers or promotions by accessing the unsubscribe link displayed in the commercial communications received from the Operator or by directly contacting the Operator with an expressed request to that end at the email address office@theestate.ro with the subject "Unsubscribe".


3. Transfer to third party countries
It is possible that some data regarding direct marketing campaigns to be transfered to empowered persons in third party countries, countries which offer a similar protection level or to the US (only companies subscribed in EU-US Privacy Shield). One of these third party empowered persons could be Mailchimp email marketing service, who undergoes marketing activities. The User or Client accepts the possibility of email marketing data transfer to the US and Mailchimp's privacy policy, available at this moment at  https://mailchimp.com/legal/privacy/#contacts

4. Marketing

In order to improve the offer of goods and services and the experience of Users and Customers, the Operator may exploit the User's and Customers' data, including the data on the accessing of the newsletter's content, for market research, statistical analysis, and surveys. Information obtained from these activities will not be used for advertising purposes.

This Privacy, Marketing, and Commercial Communications Policy is updated on a regular basis; whenever the Operator makes a change, it will be displayed on the Site.
